G. Blessing made a motion to seat R. Peloquin, second by F. Dirrigl.  All in favor, thus the motion carries.
New Business

1.W2006-27- Application to construct an above ground pool in the upland review area on property at 250 Village Hill Road (Map 47, Lot 12) Owner/Applicant: Wayne Mitchell (Received 6/12/06, Public hearing/Decision 7/24/06)

Applicant was not present to discuss application.  The commission looked through the submitted application which showed a man made pond on the property.  Staff reported that when the applicant came to the office he stated that the pond is filled by gutter run off from his log cabin.  The commission looked to see if there were alternative places where a pool could be put, they felt that if it was moved approximately twenty feet it would be out of the wetlands area.  The commission decided that a commission member or staff would need to go out and look at the property to see if there was an alternate location for the pool and the application was continued to the next meeting.  

2. W2006-28- Application to construct an in-ground pool in the upland review area on property at 59 Boston Tpke. (Map 6, Lot 6A) Owner/Applicant: Michael Kennedy (Received 6/12/06, Public hearing/Decision 7/24/06)

Michael Kennedy owner/applicant was present to discuss his application.  The commission looked over the application which showed the plan for an in ground pool which is approximately 51 feet from a brook.  Mr. Kennedy stated that the brook does not flow all year long, that it usually dries up in July.  The commission asked what will happen to the dirt after excavation.  Mr. Kennedy said that it is going to be sent off site.  
G. Blessing made a motion to remand the application to staff, second by F. Dirrigl, all in favor, thus the motion carries.

Old Business
1.      W2006-24- Application for construction of two (2) single family dwellings within the regulated area on parcel A & B south of 69 Loshe Rd. (Map 46, Lot 1-B)  Owner/Applicant: D. W. Fish Home Builders, LLC.  (Received 5/8/06, Site walk 5/22/06 at 6pm, Public Hearing/Decision by 7/10/06)

Mark Peterson the applicants engineer was present to discuss application.  He had four variations to the original plans to show the commission the various ways the driveways could be constructed.  Plan C would have two side by side driveways, plan D would require moving the septic system so the driveways could be placed in a different location that would have less of a steep grade, but still be side by side.  
S. Yorgensen asked if Mr. Peterson considered having a common driveway.  Mr. Peterson said he did not due to needing a variance from planning and zoning.  S. Yorgensen said that he should consider a common drive that the planning and zoning commission may be likely to grant a waiver due to the fact that less wetlands would be disturbed.
Mr. Peterson explained plan E which would have the driveway cross on only parcel A or B giving an easement to one of the property owners.
Mr. Peterson said that he would create a plan for a common driveway and bring the maps to the next meeting.  

2.      W2006-25-Application for construction of driveway, utilities, erosion control and grading within the regulated area on 37 Clover Springs Dr. (Map 9, Lot 7-12) Owner/Applicant: Beyor Builders, Inc. (Received 5/8/06, Decision by 7/10/06)

Mark Peterson the applicants engineer was present to discuss the application.  Mr. Peterson stated that he meet with the town engineer to discuss the changes that would need to be made, he stated that the town engineer suggested removing one of the street catch basins due to current water flow going into the existing culvert which flows south.  
The commission stated that the erosion control area north of the driveway seemed very steep which will cause water to flow onto the drive way.  Mr. Peterson said that vegetation could be planted to stop the water before it reaches the driveway.   The commission asked if this could be written into the deed so future owners maintain the planted vegetation.  Mr. Peterson said he will discuss it with his client.  

3.      Cease and Desist Order issued to Joseph Voboril Re: Clover Springs Subdivision Wetlands Permit #2004-04 off Battye Road.  Site Walk 10/24/05 9:30 AM

Site walk will be set for end of June or in July.

4.      File #2003-49- Notice of Violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road

David Plumber and Rylan Farr from Apex environmentalists were present to discuss the notice of violation.  Mr. Plumber handed out a chronology of events to the commission to go over what happened from the date of the diesel spill to today.  He went over the removal of sediments, the vegetation that was planted, and how the pond was pumped and cleaned.  He stated that no petroleum products have measured above DEP acceptable levels at current time.  It was discussed how and where water samples were taken.  
The commission asked Mr. Plumber if any recommendations have been given to the management so that a spill like this does not happen again.  Mr. Plumber discussed the changes that will be put into place at the Travel Center.  These include a storm drain being paved over near the fill site, and a fuel separator will be installed.  The new procedure for the truck driver delivering fuel requires them to weigh the truck when they arrive, go inside to get a ticket from the fuel cashier.  They must then be outside and watch their hose during the fuel drop.  There is a camera on them during the drop that is watched by the cashier.  Once the fuel is dropped the truck is weighed again and the gauge on the truck is read and compared to the tickets.  
The spill containment arrears near the fill tanks now have alarms on them which will go off when they have reached capacity and need to be emptied.  
The commission stated that the storage tanks did not work originally so why will they work now if there is another spill.  Mr. Plumber discussed the mechanical changes that were made to the storage tanks.  He stated that there were several mechanical errors that occurred due to parts within the tank being installed incorrectly which have now been fixed.  

The commission asked for a summery of the new spill prevention plan to be submitted to them as well as to DEP.  
Mr. Plumber discussed the on going plan to monitor the surrounding wetlands and pond as well as the timeline that the changes at the Travel Center will take place.  
Rylan Farr stated that he will now send the commission any information that he sends to DEP so they are aware of what is going on as well.

Approval of minutes

F. Dirrigl stated that his name was misspelled in the minutes.
G. Blessing made a motion to accept the minutes from the last meeting with the spelling correction.  F. Dirrigl seconded the motion.  All in favor, thus the motion carries

Staff report and Discussion

The board decided that S. Yorgensen would write a letter to the selectmen to discuss the cleaning of the catch basins.  

The commission discussed the amount of work the staff is responsible for.  S. Yorgensen reported that she finds it difficult to keep up with work with all the new applications coming in as well as enforcement and monitoring special permits that have been issued in the past, some of those things including the aquifer requirements, regulations, enforcement etc.  The commission discussed whether or not they could hire another employee or contract with an outside agency to do some of the work.
